Terms of Service

These Terms and Conditions ("Terms") apply to all services, products, and business transactions conducted by Sound & Vision by Bergee, located in Sint Maarten. By engaging with us in any form—whether for retail purchases, rentals, repairs, event services, or AV installations—you agree to be bound by the terms outlined below.

2. Scope of Services

These terms cover:

  • Retail sales of musical instruments and AV equipment

  • Rentals of AV and musical equipment

  • Repairs and maintenance services

  • Full-service event production and support

  • AV system installations (commercial and residential)

We do not offer retail or rental product delivery. All items must be picked up in-store or serviced on-location.

3. Quotes and Pricing

  • All quotations are valid for 14 days unless otherwise specified.

  • Prices are in USD and may be subject to change due to supplier pricing, import fees, or currency fluctuations.

  • Prices exclude VAT unless explicitly stated.

4. Payments

  • Accepted forms of payment: Cash, debit/credit card, bank transfer.

  • Some services may require a deposit or full prepayment.

  • Outstanding balances must be settled before pickup or service execution.

  • Late payments may incur interest or collection fees.

  • For events and installations, a 50% non-refundable deposit is required at the time of booking to secure the date and resources. The remaining 50% must be paid before or on the day of service delivery.

5. Cancellations and Rescheduling

  • Retail purchases are final unless otherwise specified.

  • Custom orders, once confirmed, are non-refundable due to the specific nature of the request.

  • Rentals, events, and installations must be cancelled at least 14 days (2 weeks) in advance due to the logistical challenges of island-based operations and reliance on off-island shipping. due to the logistical challenges of island-based operations and off-island shipping dependencies.

  • Cancellations after this period may result in forfeiture of the deposit, except in documented emergency situations which will be reviewed on a case-by-case basis.

  • Rescheduling is possible subject to availability.

6. Rentals

  • A valid ID and deposit may be required.

  • Renter is responsible for loss, theft, or damage.

  • Late returns are subject to additional charges.

  • All equipment must be returned in the same condition as received.

7. Repairs

  • Diagnostic fees may apply and are non-refundable.

  • Warranty on repairs is limited to the parts and service performed (typically 30 to 90 days).

  • We are not responsible for data loss or further damage due to pre-existing conditions.

8. Events and Installations

  • Project timelines are estimated and may be adjusted due to weather, client readiness, or force majeure.

  • The client must ensure access to the premises, including power supply and equipment space.

  • Designs, programming, or custom setups remain our intellectual property unless otherwise agreed.

9. Warranties and Returns (Retail)

  • Unused, unopened items may be returned within 7 days with proof of purchase.

  • No returns for used items, cables, custom orders, or discounted items.

  • Manufacturer warranties apply where relevant.

10. Liability

  • Our liability is limited to the amount paid for the product or service.

  • We are not liable for indirect, incidental, or consequential damages.

  • Clients are advised to maintain proper insurance for rented equipment or event coverage.

11. Intellectual Property

  • All content, images, and designs provided by us remain our property unless otherwise licensed.

  • Event photos may be used for promotional purposes unless the client opts out in writing.

12. Privacy

  • We collect and process personal data in accordance with our [Privacy Policy].

  • Personal data is used only for business-related purposes and never sold to third parties.

13. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, or government actions.

14. Disputes and Applicable Law

  • These terms are governed by the laws of Sint Maarten.

  • Disputes shall first be addressed through mutual consultation. If unresolved, the matter may be brought before the competent court in Sint Maarten.
